Terms & Conditions - Updated October 2024
1. Accommodation – The Brewers Cottage Holiday Let is available from 3pm on the first day of booking. Departure from The Brewers Cottage Holiday Let is by 10am strict on the day of departure, the accommodation must be vacated and the equipment, furniture and premises handed back in the same good a condition as it was when taken over [see below]. Departure from the cottage must be no later than 10am. Departure after 10am severely impacts on the servicing time required, and the arrival of incoming guests. We therefore give notice that we shall deduct from the Good Housekeeping Deposit £50 for each hour (or any part of each hour over 10am) that departure is delayed over 10am on the day of departure.
2. Care of our property The Brewers Cottage - you agree to (a) leave our cottage in good order and in the same clean condition as found, otherwise a cleaning charge will be levied; (b) pay for any loss or damage caused by you, or your party excluding reasonable wear and tear, during occupation (c) forfeit the good housekeeping deposit should heavy cleaning be required, or damage to any aspect of our property occurred.
*Please Note: The good housekeeping deposit is in place to cover loss or damage to our property or any of its contents. Our caretaker is asked to contact us immediately after guest(s) departure if there is a need to withhold the good housekeeping deposit. Photographic evidence of damage will be taken and used if necessary. While it is rarely necessary to hold the good housekeeping deposit as most people are very careful and respectful this system is in place to protect ourselves.
The good housekeeping deposit will be returned to you by your preferred method within 7 days of your departure from The Brewers Cottage proving no issues are brought to our attention.
3. Number of persons using The Brewers Cottage – There must be NO more members in your party than the cottage is designed to accommodate which is a maximum of four adults. All members must be listed by name on the booking form. This is an insurance requirement and must be adhered to for fire safety.
4. No Smoking Policy – The Brewers Cottage is strictly non-smoking. Smoking is not allowed under any circumstances in any area of the property. If evidence of smoking is found the good housekeeping deposit will be forfeited. Fire safety is a priority.
5. Dogs – Maximum number of dogs permitted in The Brewers Cottage at any time is strictly restricted to two over 12 months of age. Dogs are not allowed onto the furnishings or into the bedrooms or bathroom. Dogs must not be left in the cottage unattended. Whilst we warmly welcome dogs they must be kept under control at all times. They must not be allowed to foul anywhere on the premises. Accidental fouling must be cleaned up immediately. Pets other than dogs are not permitted. Puppies (Dogs until the age of 12 months) and giant breeds are NOT permitted in the cottage. As owners if the cottage we shall not be held responsible for any injury, accident or damage caused to, or by your dog(s) during your stay at our property. Our insurance does not cover damage by domestic pets. We provide one large plastic dog bed however we do not provide dog bedding/towels or feeding bowls, please bring your own. Guest towels must NOT be used for dogs. Wildlife exits in the garden must NOT be blocked off to keep dogs safe & secure. We do NOT permit cats or other types of pets in the cottage.
6. Right of entry – Mr Steven Brockbank,
Mrs Julie Brockbank or their representatives must be allowed access to The
Brewers Cottage during your stay if required to do so.
7. Termination of Stay – Mr Steven Brockbank and Mrs Julie Brockbank reserve the right to terminate your stay if you, or members of your party are believed to be causing a nuisance to others or are not treating the property with due respect. You are expected to maintain reasonable behaviour whilst staying at The Brewers Cottage.
8. Liability – The use of The Brewers Cottage is entirely at the user’s risk and no liability can be accepted for death, injury, expense, loss, inconvenience or damage to users or their belongings including vehicles, cycles, motor cycles, boats etc. The owners shall not be liable to you or any other member of your party for any loss or damage to yourselves or your property however caused in relation to, or connected to the letting. The owners of the Brewers Cottage are not insured for, nor responsible for the loss of, or damage to items of jewellery or similar valuable items.
9. Children – We do not accept babies or children under 18 years of age.
10. Cancellation – By making your booking your agreement is a legal contract. In the event you need to cancel any cancellation made by telephone must also be confirmed in writing within 48 hours.
(I) In the event you have to cancel your booking after you have paid your deposit we will make every effort to re-let the property in which case all monies will be returned to you less a £50.00 administration fee. However, if we are unable to re-let the property, we have to advise you that you will be liable for the loss of your 50% booking deposit.
(II) In the event you have to cancel your booking after you have paid in full we will make every reasonable effort to re-let the property in which case all monies will be returned to you less a £50.00 administration fee. However, if we are unable to re-let the property we have to advise you that you will be liable for the full cost of your cancelled booking, and we will be entitled to retain the deposit and full payment. * Please Note – Your booking is a legally binding contract and like all contracts it is advisable to cover yourself in case things go wrong. To avoid the added stress of cancellation charges, and for your peace of mind we highly recommend that you take out holiday cancellation insurance. As owners of the property we are unable to offer advice on holiday cancellation insurance.
11. Cancellation by Owners – We the owners Mr Steven Brockbank and Mrs Julie Brockbank reserve the right to refuse any booking or to cancel any bookings already made subject to refunding any sums you have paid in full without further liability on our behalf, if for any reason the booked accommodation becomes unavailable; liability shall be limited to a full refund of the monies paid to The Brewers Cottage.
12. Property Description – The Brewers Cottage property description and inventory are accurate at the time of press. Any changes will be notified to you as soon as possible after we have been made aware of the situation. All information is given in good faith and believed to be correct. We cannot be held responsible for changes, errors, or omissions in the property description.
13. Linen – Bed linen is provided at The Brewers Cottage plus one bath towel and one hand towel per guest. Each bed is prepared with a waterproof mattress cover please do not remove these covers, soiling of the mattress(s) will incur the loss of the good housekeeping deposit. Please do not remove our linen from the property other than for the purpose of laundering. Guests staying more than one week can request a linen change on Saturday mornings only. Please notify us if a linen change is required in advance of your stay. Our housekeeper will not enter the property and will not remove bed linen or re-make any bed.
14. Housekeeper – The Brewers Cottage is self-catering as such we do not provide any housekeeper services during your stay other than to collect and deliver clean laundry for guests staying in excess of one week (if requested). Our housekeeper will enter the cottage at 10am prompt to inspect and service the cottage on the day of your departure.
15. Parking – Parking at The Brewers Cottage is restricted to two vehicles which must be parked at the front of the cottage through the double wooden gates. The gates must be kept closed at all times to keep livestock out. The large parking area at the rear of the cottage belongs exclusively to The Old Brewery next door and should not be used for parking at any time. The drive access is shared but owned by The Old Brewery please do not obstruct the drive at any time during your stay.
16. Electricity/ Heating – Electricity for the cottage appliances, lighting and cooking is included in the rental cost of The Brewers Cottage, as is the timed background heating. The heaters are programme locked and set to come on and go off at intervals throughout the day and cannot be altered. Electricity for charging an electric car is NOT included in the cost of your stay. Electricity usage is logged each Saturday following guest departure. Excessive over use (i.e. that incurred charging an electric vehicle) will incur a fee based on current electricity provider unit rates. This fee will be deducted from the good housekeeping deposit. If you wish to charge an electric vehicle the owners must be contacted in advance.
17. Log Burner – The Brewers Cottage log burner is for the strict use of logs only, burning anything other than logs causes damage to the log burner and the flue and is a safety risk. Damage caused to the log burner / flue or chimney by burning products other than logs will result in the loss of the good housekeeping deposit. Guests are welcome to use our supply of logs for an honesty donation of £6.50 per bag (log bags provided in the log store). The donation should be left in the honesty jar provided or paid online upon departure to the BACS details supplied at the time of booking.
18. Groups of Young People – We regret we are unable to accept bookings from groups of people under the age of 25 at The Brewers Cottage.
19. Price Changes & Alterations – The owners reserve the right to amend any prices or details due to omissions or errors in the advertising of The Brewers Cottage
20. Left / Lost Property – The owners cannot be held responsible and accept no liability for any items lost, stolen or left behind at The Brewers Cottage. However, for the cost of the postage and the caretaker handling fee of £15.00 we will return left items to you by post.
21. Wi-Fi / Telephone – The Brewers Cottage has a telephone line restricted to incoming calls only. The cottage also has basic broadband installed which is very slow and intermittent to the village at most times. The internet speed and reliability is out of our control and as such we cannot be held responsible for the standard or connection of service.
22. Green Policy – The Brewers Cottage is committed to a greener future. Please turn off lights and electrical items of when you are not in the room or go out of the property. Please do not leave phone chargers pugged in when not in use. Please turn the radiant heaters off at the wall if the property is too warm for your requirements, or in rooms not being used.
23. Recycling / waste Collections – Waste and recycling collections operate on alternate weeks. The Brewers Cottage has a commercial waste licence, the incorrect use of the waste and recycling bins will result in additional costs and possible loss of licence. Do not over fill the waste or recycling bin – the lids MUST be down for collection. Recycling consists of clean plastic, tins, cardboard and paper only. Waste and recycling collection takes place on Thursday morning. Guest(s) are responsible for placing the correct bin for the week at the bottom of the drive on Wednesday evening. Glass must NOT be placed in the recycling bin. Glass items can be placed in the refuse bin or taken to recycling by the guest(s) Glass recycling is available in Cannich. Guests are advised that any inappropriate chargeable disposal of waste / recycling by The Highland Council incurred by the owners will result in the loss of the good housekeeping deposit.
24. Septic Tank – The Brewers Cottage operates a septic tank. DO NOT flush anything other than toilet paper down the toilet. If products other than toilet paper are found to have clogged the system during your stay at The Brewers Cottage the good housekeeping deposit will not be returned.
25. Security / Key Safe – The Brewers Cottage must be left locked and secured each time you depart the property. Windows and doors must not be left open when the cottage is unoccupied. keys must be returned to the key safe upon departure from the cottage at the end of your stay, and a random number set on the display. Lost keys - The replacement of keys will incur a charge. The Brewers Cottage insurance requires guests to make the property safe and secure when unattended – proven failure to do so will render our insurance null and void. As cottage owners we cannot be held responsible for any personal lost or damaged items on or off the property.
26. Deposit, Booking Form & Terms and Conditions - We must receive your booking in writing on our attached booking form (Please keep one copy plus the Terms and Conditions for your reference). In addition, we must receive your deposit equal to 50% (not including the good housekeeping deposit) of the total rental amount due. This form must be signed and dated acknowledging you and the other members of your party have read the attached Terms and Conditions. * An invoice is attached
27. Final Payment – The final payment plus the £250.00 good housekeeping deposit for your stay is due a minimum six weeks before the date on which your stay at The Brewers Cottage is due to commence. Failure to ensure that final payment reaches the owners by that date shall be construed as a cancellation of contract. The Brewers Cottage will then become available to others.
Following your failure to pay in full by the six-week deadline:
(i)In the event we can re-let the property your 50% booking deposit will be returned to you less a £50.00 administration fee.
(ii)In the event we are unable to re-let the property we have to advise you that you will be liable for the loss of your 50% booking deposit.
28. VAT - The Brewers Cottage is not VAT registered as such no VAT is incurred in your booking cost.
29. Booking Fee – A booking fee is not charged when The Brewers Cottage is booked direct with the owners via Simply Owners.
30. Weekly Let – The Brewers Cottage is let from Saturday to Saturday only we do not offer a reduced rate, special rate or a refund for late arrivals or early departures. We do not offer short breaks, mid-week breaks, or weekend breaks. We do not offer single occupancy discount.
31. Scottish Government Restrictions & Lockdowns – If by laws set by The Scottish Government we are required to close the cottage in line with National and, or local restrictions we will offer either a full refund of any payments made to date OR the chance to defer your stay to an alternative date. Deferring to an alternative date may incur extra costs relating to the dates chosen.
32. UK & Global Travel Restrictions & Local Lockdowns – If by laws set by the UK Government and, or laws set in the country in which you reside prevent you from traveling to The Brewers Cottage we will offer either a full refund of you any payments you have made to date, OR the chance to defer your stay to an alternative date. Deferring to an alternative date may incur extra costs relating to the dates chosen.
33. Privacy – This privacy notice is to let you know how we promise to look after your personal information.
We promise:
1.To keep your data safe and private.
2. Not to
sell your data.
3.To
give you ways to manage and review your marketing choices at anytime.
Data Protection Law says that we are allowed to use
personal information only if we have a proper reason to do so. The law says that we must have one or more of
these reasons:
1. To
fulfil a contract we have with you, or
2. When
it is our legal duty, or
3. When
it is in our legitimate interest, or
4. When
you consent to it.
A legitimate interest is when we have a business or
commercial reason to use your information.
This may be to describe offers etc relating to The Brewers Cottage
Holiday Let. Even then it must not
unfairly go against what is right and best for you.
You have the right to object to our use of your personal
information, or to ask us to delete, remove, or stop using your personal
information if there is no need for us to keep it.
There may be legal or other official reasons why we need
to keep or use your data. Please tell us
if you think that we should not be using it.
34. Relevant Law – This booking contract is deemed to be made in England and is governed by English Law. Any dispute is subject to the exclusive jurisdiction of the English Courts.
35. Prevention of money laundering and scam bookings – To protect our business against fraudulent bookings any payment made without a returned and completed booking form will not be processed, nor will it be safeguarded by a Simply Owners Payment Protection certificate.
Furthermore, if a payment transaction is deemed suspicious by the Brewers Cottage owners, and/or a request to cancel occurs after the transfer of funds has been made to The Brewers Cottage bank account with or without a supporting booking form the guest must wait a full 30 days for the return of funds to the issuing bank account, or request a fund reversal through their own issuing bank. At this point our bank will be notified of our concerns and actions. Clause 28 of the Terms & Conditions also applies.
36. Payment Methods – We can accept BACS Payments, secure card payments by telephone, or bank cheque Our preferred method is bank transfer.
37. International Bank Transactions – All bank transaction fees incurred must be paid for at source by the booking / paying guest. The Brewers Cottage will not incur the cost of bank transaction fees. Any such costs incurred by The Brewers Cottage will be added to the second invoice or deducted from the Good House Keeping Deposit. International guests are required to provide an IBAN / SWIFT code for deposit return.
38. Complaints – Above all want you to have a wonderful time at The Brewers Cottage. We love our cottage it is also our home and where we spend much of our time, however if for any reason you have a complaint please let us know as soon as reasonably possible and in any event before departure, to allow remedial action to be taken. We will apply our reasonable endeavours to repair or replace any faulty equipment as soon as is possible. However, no claims will be entertained into in respect of equipment which remains faulty beyond our control, and despite our reasonable endeavours.
This booking contract is between Mr Steven Brockbank and Mrs Julie Brockbank the owners of The Brewers Cottage Holiday Let and the person completing this booking form and all members of their group (referred to as “you” or “your”).
The contract will be subject to these booking terms and conditions and must be complied to.
The group leader must be over the age of 25 years at the time of booking.
The group leader must take responsibility for the entire group booking.
Should any members not conform to any of these conditions the owner or their representative reserve the right to enter the property and terminate the tenancy with immediate effect.
